1. Acceptance of Terms

By accessing or using GPT SEO ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

GPT SEO is a website analysis tool that evaluates how visible websites are to AI-powered search systems. The Service:

• Analyzes website content and generates relevant questions
• Tests whether AI language models mention your website when answering those questions
• Provides monitoring and alerting for changes in AI visibility
• Offers insights and recommendations for improving AI discoverability

The Service uses third-party AI models (including but not limited to OpenAI's GPT models) to perform these analyses.

3. User Accounts and Registration

3.1 Account Creation

You may use the Service anonymously for initial website analysis. To access full features including historical tracking and monitoring, you must provide a valid email address.

3.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. Subscription and Payment Terms

4.1 Free and Paid Plans

The Service offers both free and paid subscription plans. Free plans have limited features and usage quotas. Paid plans provide additional features, higher usage limits, and advanced monitoring capabilities.

4.2 Billing

• Subscriptions are billed on a recurring basis (monthly or annually) as selected during purchase.
• Payment is processed through Stripe, a third-party payment processor.
• You authorize us to charge your payment method for all fees incurred.
• All fees are non-refundable except as required by law or as explicitly stated in these Terms.

4.3 Automatic Renewal

Paid subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can cancel your subscription at any time through your account settings or the Stripe Customer Portal.

4.4 Price Changes

We reserve the right to change subscription prices with at least 30 days' notice. Price changes will apply to subsequent billing periods after the notice period.

5. Acceptable Use Policy

5.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service only to analyze websites that you own or have explicit permission to analyze.

5.2 Prohibited Activities

You agree NOT to:

• Analyze websites without authorization from the website owner
• Use the Service to harass, harm, or impersonate others
• Attempt to gain unauthorized access to the Service or related systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scrapers) to access the Service except as explicitly permitted by our API
• Transmit viruses, malware, or other malicious code
• Violate any applicable laws or regulations
• Resell or redistribute the Service without our written permission
• Use the Service to spam or send unsolicited communications

6. Intellectual Property Rights

6.1 Our Rights

The Service, including all content, features, functionality, and software, is owned by GPT SEO and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service.

6.2 Your Content

You retain ownership of any website URLs and content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing the Service.

6.3 Analysis Results

The questions, analysis results, and reports generated by the Service are provided to you for your use. You may use these results for your own business purposes but may not redistribute them as a competing service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Guarantees that the Service will be uninterrupted, error-free, or secure
• Guarantees regarding the accuracy, reliability, or completeness of analysis results
• Guarantees that AI visibility improvements will result from using the Service

AI models are constantly evolving, and results may vary over time. The Service provides analysis and insights but cannot guarantee specific outcomes.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GPT SEO SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from your use or inability to use the Service
• Damages resulting from reliance on analysis results or recommendations

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless GPT SEO and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Service

10. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

11. Third-Party Services

The Service relies on third-party services including OpenAI for AI analysis and Stripe for payment processing. We are not responsible for the availability, accuracy, or performance of these third-party services. Your use of third-party services is subject to their respective terms and policies.

12. Service Availability

We strive to maintain high availability but do not guarantee that the Service will be available at all times. We may suspend or discontinue the Service, or any part thereof, temporarily or permanently, with or without notice. We are not liable for any interruption or discontinuation of the Service.

13. API Usage

If we provide API access in the future, additional terms and rate limits will apply. API access may be subject to separate fees and will require explicit authorization.

14. Governing Law and Dispute Resolution
